Terms and Conditions of Use

This Terms and Conditions Agreement (“Agreement”) governs your access to and use of www.KimCoachingGroup.com and all content, programs, products, features, and services offered by the Company on or through the Site (collectively, the “Site” and “Services”).

6.2 Client Responsibility

You acknowledge that you are fully responsible for your choices, decisions, actions, and results. The Coach makes no guarantees regarding specific outcomes.

6.3 Program Participation

Group programs may be recorded. By participating, you consent to such recordings. Recordings and program materials are for your personal use only and may not be shared or distributed.

7. Disclaimers

7.1 No Warranties

The Site, its content, and all Services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure, error-free, or accurate.

We do not warrant that any defects or errors will be corrected, or that the Site or its servers are free of viruses or other harmful components.

7.2 No Professional Advice

8. Limitation of Liability

In no event shall our total liability exceed the greater of $100 or the amount you have paid to us in the prior 12 months.

10. Copyright Infringement (DMCA Process)

If you believe any content on the Site infringes your copyright, please provide written notice to our Copyright Agent with the following:

1. Signature of the copyright owner or authorized agent

2. Description of the copyrighted work you claim has been infringed

3. Location of the infringing material

4. Your address, phone number, and email

5. Statement of good faith belief that the use is unauthorized

11. Dispute Resolution & Governing Law

This Agreement is governed by the laws of the State of California. Any disputes will be resolved under California law.

You agree to first attempt informal negotiation. If unresolved, disputes may proceed to mediation and then binding arbitration. Venue shall be in San Mateo County, California.

Time Limit on Claims. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Site, the Services, or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Class Action Waiver. You and Kim Coaching Group / Betterself.ai LLC agree that any dispute, claim, or controversy arising out of or relating to the Site, the Services, or these Terms shall be resolved on an individual basis only. You waive any right to bring or participate in any class, collective, consolidated, or representative action. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual claim.

12. Severability

If any provision of this Agreement is held invalid, the remaining provisions will continue in full force and effect.

13. Waiver

Failing to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision.

14. Termination

We may terminate your access to the Site and Services at any time for conduct we consider harmful or in breach of this Agreement.

15. Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the complete and exclusive understanding between you and Kim Coaching Group and supersedes all prior agreements.
